Timeless Lifestyle

“Terms and Conditions” means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the Supplier.

GENERAL

These Terms and Conditions shall apply to all contracts for the supply of Services by the Supplier to the Customer and shall prevail over any other documentation or communication from the Customer.

Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Supplier.

Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which the Supplier may be entitled in relation to the Services, by virtue of any statute, law or regulation.

Nothing in these Terms and Conditions shall affect the Customer’s statutory rights as a Consumer.

THE ORDER

The Proposal attached to these Terms and Conditions shall remain valid for a period of 7 days subject to availability.

The Customer shall be deemed to have accepted the Proposal by placing an order with the Supplier (“the Order”).

All Orders for the Services shall be deemed to be acceptance of the Proposal pursuant to these Terms and Conditions.

The client is liable for any charges incurred should they decide to cancel their booking for ticket based services. Once tickets have been ordered we will try to resell them; if we fail to do so the client shall pay the full value of the order that they are quoted; if we do resell them the client is liable for a £45 cancellation charge.

PRICE AND PAYMENT

The price for the Services is as specified in the request and any applicable charges outlined in the Proposal.

Payment of the price shall be in the manner specified in the Proposal.

CUSTOMER’S OBLIGATIONS

To enable the Supplier to perform its obligations the Customer shall:

  • co-operate with the Supplier;
  • provide the Supplier with any information reasonably required by the Supplier;
  • obtain all necessary permissions, licences and consents which may be required before the commencement of the services, the cost of which shall be the sole responsibility of the Customer; and comply with such other requirements as may be set out in the Proposal or otherwise agreed between the parties.

SUPPLIER’S OBLIGATIONS

The Supplier shall perform the Services with reasonable skill and care and to a reasonable standard in accordance with recognised standards and codes of practice.

The Supplier accepts all responsibility for the condition of tools and equipment used in the performance of the Services and shall ensure that any materials supplied shall be free of defects.

The Supplier provides the following guarantee(s) in relation to the Services carried out:

All reasonable requests will be completed to the Client’s specifications; however in certain situations alternatives may be applied/supplied.

LIMITATION OF LIABILITY

Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for death or personal injury; however the Supplier shall not be liable for any direct loss or damage suffered by the Customer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Services.

The Supplier shall not be liable under any circumstances to the Customer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Customer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.

For the avoidance of doubt, time shall not be of the essence and the Supplier shall incur no liability to the Customer in respect of any failure to complete the Services by any agreed completion date.

Artwork is not insured as it is classed by the insurance company as paper, unless it is specifically requested at time of booking.

Where you purchase food from any participating restaurant, or goods or services from any of our other partners, any losses or liability arising out of, or in connection with, such food, goods or services (as applicable) shall be the relevant participating restaurant or partner’s liability. We accept no liability for any bad experiences or bad food or service at any of the participating restaurants or partners. We will not become involved in any dispute between you and any restaurant or partner.

Membership Fees, Cancellations and Refunds

1. Timeless Lifestyle Membership is payable annually in advance by a secure internet payment. Membership will continue in perpetuity unless cancelled. Six months is the minimum membership period, after which cancellation can be made at any time.

2. You may cancel this agreement for a full refund at any point within seven working days as long as you have not used the service.

3. If you wish to cancel your membership at any point after seven days (or after the service has been used) then please contact Timeless Lifestyle. There is a six month minimum membership period. If you have paid annually in advance, a pro rata refund from the end of the current second quarter will be arranged

4. Timeless Lifestyle reserves the absolute right to cancel or suspend your Membership (at its sole discretion) for any reason whatsoever. If Timeless Lifestyle cancels your Membership, if applicable, it shall refund the balance of any annual Membership fee on a time-apportionment basis in respect of the unexpired period to which the annual Membership fee has been paid.

FORCE MAJEURE

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

Venues Access

Access to all venues is subject to availability and any rules and restrictions imposed by the individual establishment and their door policy, therefore cannot be guaranteed. These restrictions are likely to include, but are not restricted to:

1. Dress code – dressing smartly or as appropriate to the venue

2. Intoxication – if inebriated you are likely to be refused entry

SEVERANCE

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
